Long story short: back in October 2006, a credit card got a judgment against me for the sum of approximately $1,000. Last friday (March 21), they placed a levy on my bank account (basically a child support payment and tax refund, totaling about $800, is being held). The way the bank was talking, they will continue to take any funds that are deposited, up until they get the entire amount I owe... is this true? I'm unsure of how this works, and no one can seem to give me a straight answer, I have gotten two different ones from the bank as it is.
Secondly, are they allowed to take my son's child support? Because that was also in the account. It is a direct deposit, put in every two weeks, and a payment was put in over the weekend, and should be through by Tuesday or Wednesday... will this be taken as well?
IF they are not allowed to take the support payments, how do I go about getting the money back? The woman at the bank said I would have to show the attorney/law firm three months worth of statements, and even then she wasn't sure if I would be able to get the support back that was taken. I'm assuming this process will take weeks, so until then, they are able to take the support and any deposits?
Thank you in advance!
edit: i finally did get in contact with the attorney who is handling the case, and she said that they cannot take child support. i'm sure it varies state-to-state, but in PA & NJ, they are not allowed to take support payments. The attorney told me it was just a matter of faxing her statements showing the payments, and that those funds would be released.
Thank you all, though!
